AIA - Outcome of judicial review relating to ComCom process

30/10/2025, 08:30 NZDT, GENERAL

Auckland Airport advises that it has received the High Court’s decision on the judicial review of the Commerce Commission’s Airport Services Input Methodologies (IM Review 2023) Amendment Determination, filed by Air New Zealand, Qantas, and the Board of Airline Representatives New Zealand. The High Court has determined that no relief be granted in response to the application by airlines. This decision confirms that certain technical errors made when determining the airport services cost of capital be dealt with as part of the merits review appeal of the same determination. This appeal was filed by regulated airports and the New Zealand Airports Association in February 2024. Auckland Airport is currently awaiting the High Court’s decision on this appeal. For further information, it is understood that the High Court decision on the judicial review will be released later today.
